Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the BodyLapse iOS application and related services (the “Service”). By using the Service, you agree to these Terms.

1. Eligibility

You must be at least 16 years old (or the age of digital consent in your country, whichever is higher) to use the Service. By using the Service you represent that you meet this requirement.

2. Not medical advice

BodyLapse is a fitness and wellness tracker. It is not a medical device. Body composition estimates, habit recommendations, and AI coaching insights are for informational purposes only and should not be used to diagnose, treat, cure, or prevent any disease. Always consult a qualified healthcare professional before beginning any diet or exercise program, especially if you have a pre-existing condition or are pregnant.

3. Your account

You are responsible for maintaining the security of your Apple ID. You are responsible for all activity that occurs under your account. Notify us immediately at support@bodylapse.fit if you suspect unauthorized access.

4. Subscriptions & billing

BodyLapse offers auto-renewing subscriptions and a one-time lifetime purchase through Apple's in-app purchase system.

  • Subscriptions auto-renew at the end of each period unless cancelled at least 24 hours before renewal.
  • You can manage or cancel your subscription in iOS Settings → Apple ID → Subscriptions.
  • Refund requests are handled by Apple per App Store policy.
  • Unused portions of a free trial are forfeited if you purchase a subscription mid-trial.
  • Lifetime purchases are non-refundable after 14 days, subject to App Store policy.

5. Acceptable use

You agree not to:

  • Reverse engineer, decompile, or disassemble the app.
  • Resell, sublicense, or commercially exploit the Service.
  • Upload illegal, harmful, sexually explicit, or infringing content.
  • Upload photos of anyone other than yourself without their consent.
  • Attempt to gain unauthorized access to our systems.
  • Use the Service to develop a competing product.
  • Circumvent rate limits, subscription paywalls, or security measures.

6. User content

You retain ownership of all content you submit to the Service, including progress photos, measurements, and habit logs. You grant us a limited, worldwide, royalty-free license to host, process, and display your content solely to operate and provide the Service to you.

We do not use your content to train public AI models. We do not sell or license your content to third parties.

7. AI-generated content

The Service uses third-party AI models (including OpenAI) to generate body composition estimates and coaching insights. AI output may be inaccurate, incomplete, or misleading. You should not rely on AI output as a substitute for professional medical, nutritional, or fitness advice.

8. Intellectual property

The Service, including its software, trademarks, logos, and original content, is owned byBodyLapse and protected by copyright, trademark, and other intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes subject to these Terms.

9. Termination

You may terminate your account at any time via Settings → Delete Account. We may suspend or terminate your access if you violate these Terms. Termination does not relieve you of any outstanding payment obligations.

10. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BODYLAPSE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING OUT OF YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold us harmless from any claim arising out of your violation of these Terms or your misuse of the Service.

13. Governing law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-laws principles. Disputes shall be resolved in the state or federal courts located in Delaware, unless your local consumer protection law provides otherwise.

14. Changes

We may update these Terms from time to time. Material changes will be announced in-app. Your continued use of the Service after the effective date constitutes acceptance.
